USER ACKNOWLEDGMENT AGREEMENT
The California Department of Human Resources (CalHR) has contracted with The StayWell Company (StayWell, a third party vendor, to provide a wellness program service. This is a voluntary health and wellness benefit for state employees, and includes an online platform for health challenges, peer support, and information on health related matters. Your name and a valid department email address are required for registration.
All wellness information provided by StayWell is for educational purposes only and should not be construed as a substitute for medical advice from your health care provider. Relying on any information provided by StayWell and/or utilizing any program service features, including, but not limited to, ask the physician, curriculum, exercise videos, and/or recipes, is solely at your own risk. Always consult with your health care provider before beginning any health program.
Personally Identifiable Information (PII) and/or Protected Health Information (PHI) is not required to participate in StayWell’s service. You may choose to provide StayWell with your weight, blood pressure, and pulse rate. This information will be displayed on your personal profile for purposes of self-tracking, but the information will not be viewable by others. If you provide PII and PHI to StayWell, your PII and PHI will not be included in StayWell wellness reporting without your voluntary express consent. However, StayWell may provide CalHR, Healthier U partners, department leadership, and department wellness coordinators with de-identified, aggregate data, such as participation rates, number of steps taken, weight, blood pressure, pulse rate, and self-reported health information/behaviors from voluntary participant surveys. This information may be collected to design an effective, evidence-based wellness program for purposes of improving employee health by addressing chronic conditions such as diabetes and hypertension through diet and physical activity.
You may not be discriminated against in employment because of any medical information you provide as part of participating in StayWell’s program, nor may you be subjected to retaliation if you choose not to participate.
Only state active employees can participate in this service. Any inappropriate and/or non-germane wellness postings and/or use of StayWell’s service may result in termination of use.
This agreement also serves as written notice to participating employees pursuant to the American Disabilities Act (ADA) and Health Insurance Portability and Accountability Act (HIPAA).
